O’Brien clarified that he is not opposed to adult-use cannabis legalization in principle but is concerned about the specific language of the ballot initiative. He argues that the initiative’s framework, which provides an option rather than a mandate for regulators to approve additional licenses, could lead to a monopolized cannabis economy favoring existing medical marijuana companies like Trulieve.

“If you look very closely at the writing, they just messed up—and it was with full intent to mess this up,” O’Brien stated. “All they had to do was make a simple change from ‘may’ issue more licenses to ‘must’ issue more licenses, and we would have had a recreational market.”

Criticism and Justification

Despite criticism for contributing to DeSantis’s PAC, O’Brien defends his support by highlighting DeSantis’s consistent backing of small businesses. He believes his contribution would have a greater impact supporting the governor’s PAC rather than independently opposing Amendment 3.

“All he has done since being in office—at least for me, being here with boots on the ground, in regard to small business—is fight for it,” O’Brien said. “Why in the world, as a small business, when I’m going up against a giant, why would I not align myself with such a mindset?”
