Incidental THC

The term Incidental THC refers to the trace amounts of tetrahydrocannabinol naturally present in a hemp product that are not intended to produce intoxication. Under the 2026 Continuing Appropriations and Extensions Act (CAEA), the federal government has redefined the boundaries of “incidental” versus “intentional” THC to eliminate the psychoactive hemp market.
