The Michigan Cannabis Regulatory Agency (CRA) has taken decisive action by recalling nearly 1,100 pre-packaged marijuana joints due to safety concerns. These joints, already sold or in inventory at 20 dispensaries across Michigan, were flagged over potential public health risks.
Allegations Against Flavor Galaxy
The CRA has pointed fingers at Flavor Galaxy, the manufacturer operating a processing facility in Hazel Park, for allegedly adding ingredients to the joints after they underwent safety testing, a violation of state regulations. Additionally, the agency accused Flavor Galaxy of failing to accurately record tracking data in the statewide monitoring system, METRC.
Manufacturer’s Defense
Denise Policella, representing Flavor Galaxy, refuted the allegations, stating that the claims about adding ingredients post-testing were baseless. She argued that these assumptions stemmed from a former employee manipulating data in the tracking system.
Testing Discrepancies
The recall bulletin revealed that Flavor Galaxy did not subject certain infused pre-rolls to testing in their final form, only testing the raw marijuana flower. State regulations mandate that products containing added terpenes or distillate must undergo retesting in their final form before sale.
Consumer Advisory and Product Status
In addition to the recalled pre-rolls, the CRA issued a consumer advisory concerning other Flavor Galaxy products, including vaping cartridges and pre-rolls, suspected of bypassing required safety testing. While not subject to recall, these products raise concerns about compliance with safety standards.
Response from Flavor Galaxy
Flavor Galaxy vehemently denied any wrongdoing, asserting that their products passed testing, are properly labeled, and have not caused adverse health effects. They emphasized their commitment to safety and compliance with regulatory standards.
Regulatory Actions
The CRA placed a hold on nearly half of Flavor Galaxy’s products in February during the investigation, though the hold on unaffected products has since been lifted. This recall marks the first formal action by the CRA since July 2021, underscoring the agency’s commitment to consumer safety and regulatory compliance.
