Delaware’s Office of the Cannabis Commissioner has introduced an interactive map to aid residents in identifying areas disproportionately impacted by high marijuana-related arrest, conviction, and incarceration rates.
Eligibility Criteria
Residents who have lived in designated disproportionately impacted areas for at least five years out of the preceding 15 years may qualify for a recreational marijuana license through the Social Equity License program. Applicants must also demonstrate at least 51% ownership and control of the business.
Disproportionately Impacted Areas
The map highlights regions including Wilmington, areas south of the city along the Delaware River, parts of Middletown, Smyrna, Dover, Seaford, Laurel, Millsboro, and others with high arrest and incarceration rates for marijuana offenses.
Additional Qualification Criteria
Beyond residency in impacted areas, eligibility includes having a prior conviction or being associated with someone convicted of a marijuana-related offense under Delaware law, or having majority ownership in the business.
Validation and Application Process
Interested candidates must submit an eligibility validation form by July 15, validated by the Office of the Marijuana Commissioner without charge. The application period opens on September 1, offering technical assistance, guidance, and discounted fees for qualified applicants.

A public workshop remains available for those seeking more information about the equity program, scheduled for June 26 at the Dover Public Library or accessible online via the office’s Facebook page.
