Minnesota’s Journey to Legal Cannabis: Progress and Challenges One Year After Legalization

It was August 1, 2023, when self-described weed enthusiasts celebrated at First Avenue as Minnesota legalized recreational marijuana. While significant strides have been made in the past year, experts indicate that the state still has a considerable journey ahead in fully realizing its legal cannabis industry.

Early Progress and Industry Excitement

“I think we’re at a really exciting juncture now for the industry here in Minnesota,” said Leili Fatehi from Blunt Strategies, a cannabis government relations and policy firm. This sentiment captures the optimism surrounding the budding industry.

Limited Dispensaries on Tribal Land

Since the legalization, only a few dispensaries have opened on tribal land, providing the public with access to legal marijuana. The state is still developing the rules and licensing process for additional dispensaries, which are expected to open next year.

State Licensing Delays

“So there are currently still no state-licensed adult-use cannabis dispensaries. Those won’t be opening up until probably closer to the end of 2025,” said Fatehi. This delay highlights one of the significant challenges facing the industry.

Home Growing Regulations

In the meantime, Minnesotans can legally grow their own marijuana, with state law permitting up to eight plants per household, but only four can be mature and flowering at any given time. However, there is a contradictory state law limiting possession to two pounds of marijuana in the home, posing potential issues for home growers.

Gifting Provisions

“But the law does allow for gifting under two ounces, as long as it’s not for remuneration, and so those green thumbs can give away their bounty to their friends,” explained Fatehi. This provision offers a way for growers to share their harvest within legal limits.

THC Beverages: A Booming Business

In the last year, THC-infused beverages have become a significant industry in Minnesota, generating nearly $200 million, according to one industry estimate. Currently, the THC in these drinks comes from hemp, but more potent marijuana-infused beverages are expected to hit the market by the end of next year.

“The industry is going to continue evolving, especially over the next couple of years,” said Fatehi. The coming years will likely see further developments in Minnesota’s cannabis industry as regulations solidify and new products become available.
