German Bundestag Approves Amendments to Cannabis Legislation

The Federal Ministry for Digital and Transport has amended the Road Traffic Act, raising the THC blood content limit from 1 nanogram per milliliter to 3.5 nanograms per milliliter. This adjustment aligns THC restrictions with Germany’s alcohol blood content limit.

Driving Violations and Penalties

Drivers exceeding the new THC limit will face a one-month driving ban and a €500 fine for the first offense. Repeat offenders will receive a €1,000 fine and a two-year driving ban. Impairment is initially tested through saliva, with follow-up blood tests if necessary.

Cannabis Clubs and Cultivation Rules

Starting next month, cooperatives or cannabis clubs will be permitted to sell cannabis to members, with a maximum of 500 members per club. These clubs will play a vital role in providing legal, safe cannabis and promoting health and youth protection.

Adult-Use Cannabis and Future Plans

Since April 1, adults over 18 can possess up to 25 grams of cannabis in public and 50 grams at home. While cannabis clubs can dispense cannabis to members, commercial sales are not yet implemented. Health Minister Karl Lauterbach is exploring commercial sales plans to advance legalization and combat the black market.

Opposition and Public Consumption

Bavaria has banned cannabis consumption at public festivals and beer gardens for public safety, despite some opposition from Bavarian officials. Germany continues refining its cannabis laws to balance public health, safety, and industry growth.
